Article I of the United States Constitution, surprisingly similar to the British constitution,
provides the House of Representatives the sole power of impeachment
and the Senate the sole power to try impeachments.
Article I, Section 2, Clause 5:The House of Representatives shall chuse [sic] their speaker and other Officers; and shall have the sole Power of Impeachment.
Article I, Section 3, Clause 7:Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.
Article II, Section 4:The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.
There is no doubt that this president
has abused his office and usurped powers that are against
constitutional limits; thereby not committed to his oath of office.
Article II, Section 1, Clause 8:Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:—"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States."
The
President of the United States has power to pardon …
Article II, Section 2, Clause 1:...he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.
Several
actions
and scandals have continued from Barack Obama's first term on into
his second term. Before the election of 2012, the Benghazi scandal
erupted in September, 2011. The executive office has used its powers
to counter any proper and efficient investigation as to whether the
president ordered military and special operations units to “stand
down” - when help of some sort was available two hours away. Those
that died at Benghazi fought for seven hours with no one except two
Navy SEALS who ignored the order and went to the aid of Ambassador
Stevens. That alone deems a complete impeachment hearing.
I
am an admirer of Keith
Koffler
at White House Dossier.
Thus I was surprised that he made a recent statement in his article:
President Obama has undoubtedly abused his office. I have not thought to date that his abuse rises to the level at which Republicans should impeach him.
There
are several reasons for congressional members not to or reluctantly
initiate impeachment:
- Instantly the racial issue will be presented, just as Eric Holder wailed when faced with his Fast-N-Furious fiasco and “investigation” of IRS.
- If Obama is impeached, Crazy Joe Biden will become President until 2016.
- In some of the cases, the congressional investigative committees have failed to get enough evidence because of records not being turned over and when demanded, claim they were lost. If a president can be impeached for blocking investigations and coverup [President Nixon] – why did this guy ever get reelected? Benghazi occurred in September 2011 and president election did not occur until November.
- Conservative leadership elite do not like to make waves and feel it would be a political fiasco; primarily with the black voters. Once again, race is inserted in this scenario.
Support for impeaching Clinton in 1998, the precedent Republicans are so worried about, never rose above 29 percent in CNN polling. And in 1998, while Republicans came up short of their hoped for gains in the midterms, they still didn’t lose the House – five seats went to the Democrats – and they broke even in the Senate.
Some,
even Koffler, state that Bill Clinton's crime was a moral one;
however, they are overlooking what would have caused the Nixon
impeachment – lying under oath and hindering justice.
Koffler's
“straw that broke the camel's back” is the possibility of Obama pardoning illegal aliens:
However, if he crowns this abuse by effectively pardoning five million lawbreakers, as he is reportedly considering – ignoring the will of Congress and failing utterly to “take Care that the Laws be faithfully executed” – I would have to reconsider my position.
What
made me think that Obama should be impeached was ordering a “Stand
Down” and ignoring the plight of Ambassador Stevens and company who
fought hard to stay alive for seven hours. Then there was the IRS
sandal, but that just shows that it is time to get rid of the income
tax system and send the IRS to history's garbage bin of examples of
bad government.
Koffler
then adds:
I’m not yet saying Obama should be impeached. Let’s see what he does. And the reaction of Americans is important, given what a difficult and historic process this is.
I
guess too many do not want to be deemed a racist.
As
I have stated before: “It is wrong to not elect someone because of
their race, but just as wrong to elect one because of race” - I
also add, it is wrong that anyone should get away with misdemeanors
and high crimes just because of race and people worrying about people
using that racial divide to prevent justice.
For
that I have no answer, but I have presented possible solutions for
the past ten years.
I
am tired of people not listening to common sense and logical
reasoning – and making constitutional law the principle of matters
rather than an afterthought.
I might want to remind Mr. Koffler that in 2013, in an article, he listed 24 scandals since Obama first became president - yet could not find justification of impeachment in any of them?
Here is a video concerning the levity of Benghazi ...
And more recently the Bergdahl deserter swap with five terrorists ...
Meanwhile an American, Jon Hammer, is held by Mexican government because he drove south of the US border with a firearm. As one can tell, the Obama administration is right on the job getting this American back home; while he wants six million illegal border crossers to be given amnesty. Initially mainstream media and even FOX News incorrectly portrayed this story as a person who made a wrong turn into Mexico. One does not make a wrong turn traveling across the border. Is the following the real story?

Addition:
Barack Hussein Obama, whose name
is going to be come infamous in history, has increased
our national debt $17 trillion; at least after people get over being intimidated as being racist for printing the truth. When Obama was senator he
chastised Bush for running up high debt (which he and Congress did)
and in 2008 campaign promise he said he would slice
the national debt in half. Of course, no one was aware that Obama
was so found of golf and expensive vacations either. No one can be
surprised about his unfulfilled
campaign promises in 2008 and 2012 and Americans who actually
think clearly and logically know he and his comrades in Congress are
corrupt liars. No one seemed to be concerned about asking just what
kind of “fundamental change” Obama would seek and his details of
his plans. He did succeed in his idea of affordable healthcare act,
well, at least passing it because it is nothing close to being
affordable and the promise spoken many times about keeping doctor/HMO
was not true either. The impact on employment is only begun to be
felt in a time with high unemployment rates. Big government tends to
kill the goose that produces golden eggs.
